    Hey guys, when does lis pendis get filed in the foreclosure process in NY? I see lis pendis listed on some properties when searching online, so it must be in public records.

    My guess is that it's filed by the lender when they finally decided to start the legal foreclosure process? And that's when search portals pick that up from public records?

    I believe Lis Pends is filed when the bank finally decides to start the legal foreclosure process. You can be delinquent on your mortgage for a long time before the bank decides to say "that's it!" and finally start the foreclosure process, which can take quite a while by itself.

    So yes, when this happens, it's a public signal that there is pending litigation on the property. Not a lawyer, but this is what I've heard and from my own experience :-)
