    You think there are busybodies running around trying to tell everyone what to do in politics? You clearly haven't lived in a condo or coop apartment in NYC before. Here's what my friend's condo building is proposing for their new condo house rules. A little excessive don't you think? More resembles a condo vs a co-op I think.

    House Rules and Regulations
    Approved by the Board of Managers in August 2018

    INTRODUCTION
    These House Rules and Regulations govern the building, lobby, recreation rooms and grounds and must be adhered to by all owners/residents of the NYC Upper Manhattan Condominium. The Board of Managers (“BOM”) reserves the right to amend or modify the rules and regulations taking into consideration any owners’ comments and will review this document on a yearly basis in spring of each year. Violations of these rules are subject to fines for a single offense. The right and use of condominium facilities and services provided directly may be denied to a unit owner, his/her family members, tenants, guests and invitees when assessments for the unit owner are more than sixty (60) days past due. These rules are not all-inclusive.

    Fine Schedule
    ─ First violation - written warning
    ─ Five days after written warning - $250
    ─ Five days after first fine - $500
    ─ Five days after second fine - $1000
    ─ Every five days after for as long as the resident is in violation, there will be an additional $1000 fine

    RULES AND REGULATIONS
    Many of these rules and regulations are contained in the Condominium Offering Plan and are accepted by each owner upon purchase of his/her unit(s).

    A. Common Areas Use:

    Common areas can be defined as the lobby, elevators, lounge, fitness center, backyard, stairwells/hallways and garage. These areas are portions of common
    elements that are customarily used jointly by unit owners, residents and their guests. Report any maintenance problems to the management company or our superintendent.
    1. Smoking is prohibited in all common areas. There is NO loitering in front of the building. Do not soil, deface, damage or litter in the common areas or interfere with the operation of the elevators or building equipment, or the work of building staff.
    2. Any alterations in appearance or operation of common areas are prohibited without the express written approval of the BOM.
    3. Owners/residents (and their guests) are responsible for any damages they may cause to common areas. Any damage to the Association’s property, other than normal wear, will be charged back to responsible owner at cost.
    4. Any items or substances willfully thrown, dropped or spilled from any balcony, terrace, or rooftop that causes damage to any common element will result in a fine. Any damage incurred will be assessed to the unit owner.
    5. Access to the roof is strictly prohibited (except for those owners who have designated space for their roof terrace), unless there is a building emergency. As the boilers are located on the roof, owners must make arrangements with the management company for access, should maintenance be required. Unauthorized entry will result in a fine to the unit owner.
    6. In accordance with fire safety laws, it is strictly prohibited to have doormats, strollers, shoes or any other items in the hallways/stairwells and in the common areas of the garage. In case of a fire, these items can become a tripping hazard and life threatening. The BOM may instruct building staff to remove prohibited items and contact owner to retrieve. The management company will issue a fine to the unit owner.
    7. No bicycles, scooters, skateboards, roller blades or other recreational vehicles are allowed in the backyard except those intended to be of use by children under 12 with adult supervision at all times. All (skate board) ramps, jumping devices and their like are expressly prohibited. There is no grinding or trick riding allowed at any time.
    8. Illegal drug use is not allowed in any area of the NYC Upper Manhattan Condominium.
    Note: Other common areas will be addressed separately in this document

    B. Commons Charges Billing/Payment Process

    Common charges are due on the 1st of the month. Each owner is responsible for making payment on time. Payments can be mailed, paid online or via direct deposit. A late fee penalty of $50 will be added if payment is not received by the 10th of the month. If payment is not received in 30 days, a notice from the Association’s attorney will be forwarded to the owner. If payment is not received in 60 days, the Association’s attorney will be instructed to file a lien on the unit or initiate collection procedures. All attorney fees associated with the aforementioned procedure will be charged back to the unit owner. Common charge statements include any additional charges such as special assessment, late charges, fines, etc.

    C. Garbage/Recycling

    All residents are required to properly dispose of their trash in accordance with New York City regulations regarding recycling. Under no circumstance may any item of trash be left in a hallway or stairwell. Items too large to drop down the trash chute must be brought down to the basement level by the resident and placed near the recycle bins. Large or bulky objects, including Styrofoam, should not be forced down the trash chute as they may block the chute or damage the trash compactor. Each refuse room has the appropriate signage posted to ensure proper disposal. Any resident found in violation of these rules will be fined.
    1. Recycled items must be placed in the appropriate bins in the refuse room. Residents are asked to wash out their recycling before disposing of it. Dirty recycling causes odors, attracts vermin and gives our staff more to do.
    2. Garbage must be in a secured/tied plastic bag when placed in the chute. DO NOT PLACE RECYCLABLE ITEMS IN THE COMPACTOR OR GARBAGE BAGS IN RECYCLING BINS.
    3. Corrugated cardboard boxes must be broken down/flattened and brought down to the designated garbage area in the garage. ONLY small cardboard items may be placed in the designated recycling bin in the refuse room.
    4. To dispose of large items (i.e. furniture, appliances), please reach out to the superintendent.

    D. Pets

    The NYC Upper Manhattan Condominium is a pet-friendly community. However, owners/residents are required to have their pets on a leash at all times when in allowed common areas. You must clean up after your pets (within and in front of the building); Violation of this rule will result in a fine. No pets are allowed in the backyard.

    E. Security/Building Access

    The NYC Upper Manhattan Condominium contracts Coop Security NYC Inc. to provide security / door person services Monday through Friday from 8am to 8pm and Saturday/Sunday from 9am to 7pm. During security off-hours, all visitors must utilize the intercom system to contact owners/residents to gain access to the building. Unit owners/residents are to use their key fobs/garage door opener to access the building/garage.

    1. Visitors must sign in during security hours and be announced to the unit owner in order to gain entry into the building. Those refusing to sign in will be denied entry. Contractors are required to sign in and show valid ID.
    2. Owners should be vigilant of strangers following them into the building and deny access to people they are not familiar with.
    3. All common element doors must remain closed (and locked where applicable) at all times.
    4. Any suspicious activity witnessed should be reported to the security officer, the management company or NYC Police Department, depending on severity.
    5. The security officer accepts all packages during operation hours and notifies owners/residents of package arrival. Large deliveries should be coordinated with the management company/superintendent to properly secure the elevators (if applicable). Damages caused by deliveries not coordinated through the management company/superintendent will be charged back to the owner.

    F. Renovations/Alterations

    Before any renovations/alterations begin in an owner’s unit, the owner must complete an application package obtained from the management company. This application requires a project summary, which includes a construction schedule, drawings, contractor’s insurance, etc. BOM approval of application is required before work can be scheduled. Any damage to the common elements during renovation/alteration is the responsibility of the unit owner. Work is permitted during the following days/times: Monday through Friday, 9am–5pm. No work is permitted on weekends unless there is an identified emergency repair warranted. If an owner fails to follow above procedures, a fine will be charged. Owners unclear if their renovation requires approval are encouraged to contact the management company for guidance.

    G. In-Unit Repairs

    As stated in the Condominium Offer Plan, all unit owners are responsible for repairs within their units, including their individual boilers. The management company and the superintendent will coordinate with an owner to assess whether or not an issue is the owner’s responsibility or a common element matter.
    ─ If an issue is part of the common elements, the Association will be responsible for repairing and will coordinate accordingly.
    ─ If an issue is identified as the owner’s responsibility and requires repair, the owner should contact the management company. The owner will also be responsible to repair any cuts in walls, ceilings or any other work done in their unit by the superintendent in order to assess the cause of their issue.

    H. Lounge/Recreation Room

    The lounge is available exclusively for owners/residents and their guests for parties or meetings.
    1. A written request to reserve the lounge must be submitted to management via email or mail with the following information:
    ─ Date and time of party
    ─ Approximate number of people
    ─ Type of party
    2. The maximum party size is 50, including the owner/residents.
    3. Party reservation time: Limited to 9am to 8pm Monday through Friday, and 9:30am to 7pm Saturday and Sunday, in accordance with security guard hours.
    4. Non-refundable reservation fee: $100 (check payable to NYC Upper Manhattan Condominium)
    5. Deposit: refundable damage/cleaning deposit of $500 is required prior to approval by the Board of Managers for any reservation. The entire deposit will be forfeited if hours of event extend the scheduled time in item #3 above. Additional time past the allotted 4 hours and within the rooms’ hours will be deducted from the deposit as per below #6 (check payable to NYC Upper Manhattan Condominium; note that this check will be cashed)
    6. The normal length of any reservation is 4 hours. $100.00 each additional hour thereafter.
    7. Reservations will be granted on a first come, first served basis.
    8. No live music, no DJs and no amplifiers are permitted.
    9. All outside vendors related to the event or party must be pre-approved by management.
    10. Trash removal: residents must remove all trash when they leave, including recyclables, cardboard boxes, etc. Please dispose of trash in accordance with building rules - do not leave trash bags in hallways or in the compactor room on the 1st floor. Lounge should be returned to original state (broom clean condition)

    I. Fitness Center

    1. The fitness center is available exclusively for the owners/residents and their guests.
    2. Users assume all risk of loss or damage to persons or property.
    3. Wear rubber soled sneakers when using aerobic equipment.
    4. Users must be 18 or older if without guardian supervision.
    5. Personal trainers must complete a no liability clause with the Association prior to entry and always accompany the owner with whom they will be working. Owners should contact the management company to coordinate completion of paperwork.
    6. Pets are not allowed in the fitness center at any time.
    7. Televisions/music volumes should be kept at respectable levels.
    8. Personal equipment may not be stored in the fitness center.
    9. Turn off all equipment/lights before leaving, and close all windows.
    10. Report broken equipment or unsafe conditions to the management company, superintendent or security officer (on duty).
    11. Do not remove any equipment from the center. As a courtesy to others, please use provided wipes to clean the equipment after each use.
    12. All equipment will be serviced as needed by a company contracted by the Association. Please do not attempt to adjust or repair any of the mechanized or weight training machines. Doing so can result in injury and a fine will be levied against the offending owner.

    J. Playground/Backyard

    1. Playground equipment may only be used by children under the age of 12 with adult supervision.
    2. Users assume all risk of loss or damage to persons or property.
    3. Pets are not allowed in the backyard at any time.
    4. No hard surface balls/bats allowed in the backyard.
    5. Other rules may be established as necessary and have the same standing as house rules.

    K. Grills

    No grills, fire pits, etc. are allowed on roof tops, terraces/balconies and in the back yard as per NYC fire code and insurance regulations. Management and staff will be conducting visual inspections on a regular basis to ensure that the fire code is being adhered to.

    L. Garage/Parking

    Parking in the garage is strictly for owners/residents who either purchased or rented a parking space(s). The Association assumes no liability for damage to vehicles, or loss or damage to personal belongings left in vehicle.
    1. It is prohibited to park in an unassigned parking space. Violators will be towed at vehicle owner’s expense and fined by the Association.
    2. It is prohibited to double-park in a single parking space. Violators will be towed at vehicle owner’s expense and fined by the Association.
    3. It is prohibited to store gas cans and any flammable items in the garage as well as in any area, private or common, of the building. Violators will be fined.
    4. Parking space owners are allowed to put up a storage unit pre-approved by the BOM in their space only if it can be placed against an exterior wall of the building and doesn’t impede movement. The Association assumes no liability for loss or damage to storage units and to personal belongings stored in the storage units.
    5. It is prohibited to keep anything in a parking space other than a motorized vehicle (and a storage unit where applicable). Violators will be fined.

    M. Bicycle Storage

    Owners and residents may rent a bike storage space(s) (if available) from the Association for $60 per year. This fee will not be prorated. Please contact management for an application. Unauthorized bicycles left in bike storage racks will have their locks clipped and will be confiscated. Offending owners will be fined.

    N. Complaints/Suggestions

    Owners/residents are directed to report complaints/suggestions to the management. Management will attempt to resolve the complaint. If a determination is made for the BOM to interject, it will be reviewed and the appropriate actions will be taken. Management and the BOM will review suggestions at monthly meetings. The review may result in a separate meeting with the owner who submitted the suggestion to further discuss. Ultimately, the BOM will determine if suggestion can be implemented or not. The final decision will be communicated to the owner.

    O. Procedures for Violations of Policy

    A specific written warning will be sent to the offending party. It will describe the violation, any corrective action to be taken and any timeline for corrections. Owner/resident has 5 days to correct the deficiency. A second infringement will result in the management company fining the owner/resident as stated in the fee schedule and will escalate if violations are repeated/ongoing. The BOM determines any subsequent response, which may ultimately include legal action.

    P. Dispute Resolution

    All disputes should be made immediately upon receipt of warning letter by contacting the management company or the BOM. The BOM will review the matter in its entirety and make the final disposition.

    Q. Building Staff & Maintenance

    The Association employs a live-in superintendent and a full-time porter to perform maintenance and cleaning of all the common areas. The building staff is supervised by our management company. The superintendent is on-call outside his scheduled hours in case of emergencies (no heat, bursting pipe, any situation where a person’s safety may be at risk). If you are aware of any maintenance issues in the common areas, please contact the management company or superintendent immediately.

    R. Fire Safety

    1. In case of a FIRE, call 911, and give the complete building address to the operator.
    2. Know where the exits are. When exiting the building, please use the stairwells. DO NOT get on elevators.
    3. If the fire is IN your unit, get everyone out. Stay low as you go and use the safest accessible exit. If possible, alert your neighbors on your floor. Call 911 once you reach a safe location.
    4. Notify the security officer, superintendent and management company promptly after calling 911.

      These house rules are terrifying. At the same time, makes me wonder if the buildings are advised by their lawyers to document anything and everything for the sake of liability protection? For example, is it really necessary to bloat the house rules by reminding people to call 911 if there is a fire? Or are some residents so totally clueless that they need a college dorm style handbook for how to handle all possible scenarios?

      The worst part about the rules above is this particular sentence: "These rules are not all-inclusive."
