Encountered this Sample House Rules that I think will be extremely beneficial to those who are planning to buy a Coop. Any thoughts?
HOUSE RULES
Including Smoking Policy, as Required by New York City Local Law 147 ( See Section P)
Effective June 1, 2018
A. PUBLIC AREAS AND ELEVATORS
1. No personal article (including bicycles, baby carriages, shopping carts, etc.) shall be placed or allowed to remain in any public area of the building, including the lobby and other vestibules, public corridors, stairways, and roof.
2. No sign, notice, advertisement or other written or pictorial item shall be affixed to or exposed on or in any window or outer door of any apartment or other part of the building, including the notice board of the Lessor opposite the mailboxes on the ground floor of the building, except as shall have been approved in writing by the Lessor. Notices may be posted on the bulletin board in the building’s laundry room subject to the discretion of the Lessor.
3. Public areas, including the lobby and other vestibules, public corridors, stairways, and roof of the building shall not be obstructed in any way.
4. No patient of any doctor who has offices in the building shall be permitted to wait in the lobby.
5. Children shall not play or be left unattended in any public area of the building, including the lobby and other vestibules, public corridors, stairways, and roof.
6. No public area shall be decorated or furnished by any Lessee without the prior written consent of the Lessor.
7. Furniture or other large or heavy items may be moved into or out of the building only on Monday through Saturday between the hours of 9:00 a.m. and 4:30 p.m. and only after obtaining prior written permission from the Lessor. Any such move shall be made through the basement only and not through the lobby. Only one elevator may be used for moving at one time.
8. Lessees are responsible for any damage and/or stains made to the walls, doors, floors and/or carpets in the public corridors, vestibules and stairways, including stains made by food delivery services and damages incurred while moving and/or during apartment renovations. Stains/damages to walls, doors, floors and/or carpets will be cleaned/repaired by the Lessor and the Lessee shall pay for such cleaning and/or repairs.
9. The extension of furniture, carpeting, etc. through the hatch of the elevator cab is not allowed, nor may any article be moved on top of the elevator, unless prior written permission is obtained from the Lessor.
B. COMPACTOR AND COMPACTOR ROOMS
10. Garbage and refuse shall be enclosed in a water-tight plastic garbage bag or container, and then deposited and disposed of in a compactor flue such that the bag drops down the flue and does not get stuck in the hopper.
11. Cartons, boxes, crates, wood and other solid objects shall not be forced into hopper openings. Small items of this nature may be left in a neat manner on the floor of a compactor room; bulky items shall be brought to the basement and left in the designated area. Newspapers, magazines and other similar material should be placed neatly on the floor of a compactor room.
C. WINDOWS, TERRACES AND BUILDING EXTERIOR
12. No awnings, window guards or, window ventilators shall be installed or used in or about the building unless approved in writing by the Lessor nor shall anything project out of any window of the building without similar approval. Air conditioning units are not permitted to be installed in any window or exterior wall.
13. No radio, satellite dish, television aerial, similar mechanism or any wiring or pipes of any kind may be attached to or hung from the exterior of the building without the written approval of the Lessor.
14. No cooking is permitted on terraces or balconies of the building.
15. The Lessee is responsible for keeping the windows of the apartment clean.
16. Nothing should be hung or shaken from the doors, windows, terraces or balconies or placed upon the exterior window sills of the building. No object of any kind, including food, paper, cigarettes, cigars, etc., may be thrown from windows, terraces or balconies. See also Section P, Smoking Policy.
17. No planting, fences, structures or lattices shall be erected or installed on a Lessee’s terrace or balcony without the written permission of the Lessor. Lessees are advised to check with the Lessor to ascertain the specific requirements before purchasing any plantings.
D. ROOF
18. The roof and roof furniture is available for the use and enjoyment of Lessees. Cooking and/or parties are not permitted on the roof.
19. Roof furniture and furnishings may not be removed from the roof for any purpose except under the direction of the Lessor. Lessees are responsible for any damage caused to the roof furniture or roof installations by themselves or their invitees.
20. No object of any kind, including food, paper, cigarettes, cigars, etc., may be thrown from the roof. See also Section P, Smoking Policy.
21. Children are not permitted on the roof unless accompanied by a supervising adult.
E. STOREROOM
22. Storage lockers and a bicycle room in the basement are reserved for use by Lessees for a license fee and subject to terms and conditions described in a license agreement that may be obtained from the Managing Agent. Application for such storage space should be made to the Managing Agent.
23. In no event shall refrigerators, stoves, other heavy equipment, furniture, mattresses, firewood, tires, boxes or other inflammable goods be stored in the basement.
24. All articles stored in the basement shall be stored at the Lessee’s own risk and the Lessor assumes no liability for damage, loss or destruction of any article so stored.
25. The Lessor has the right to remove without liability any items from the basement storage area upon five days written notice to the owner, if known, or without any notice if the owner is not known.
26. Lessor has the right to curtail or relocate any space devoted to storage purposes.
F. LAUNDRY ROOM
27. The equipment in the laundry room shall be operated in accordance with the instructions posted for each machine.
28. The Lessor has the right to curtail or relocate any space devoted to laundry purposes.
29. Laundry shall be removed promptly from washers and dryers to accommodate others waiting to use them.
30. Lessees may use the laundry facilities during such hours as shall be designated by the Lessor.
G. PLUMBING
31. Toilets and other plumbing apparatus shall only be used for those purposes for which they are constructed. No sweepings, rubbish, rags or any other article should be thrown into the plumbing. A Lessee shall be liable for any and all damage resulting from the misuse of any plumbing equipment in said Lessee’s apartment. No washing machines are permitted in individual apartments.
H. NOISE AND DISTURBANCE
32. No Lessee shall make or permit any disturbing noises or odors (including secondhand smoke and cooking odors) or interfere with the rights, comforts or conveniences of other residents, either in their respective apartments or in public areas, including the roof, public corridors, vestibules, or stairways. See also Section P, Smoking Policy.
33. No Lessee shall play or permit to be played any musical instrument, radio, television, CD or DVD player or other sound producing equipment or engage in any other noise-producing activity in the building in such a manner or at such a time as may disturb any other resident of the building.
34. No Lessee shall play, or permit to be played, a musical instrument or vocalize music in the building for more than two hours in any day between the hours of 10:00 a.m. and 8:00 p.m., and in no event between the hours of 8:00 p.m. and the following 10:00 a.m. This permission is revocable at any time by the Lessor.
35. With the exception of kitchens, bathrooms, closets and foyers, the floors of each room shall be substantially covered with rugs, carpeting or other equally effective noise-reducing material. Before installing any substitute floor covering for rugs or carpeting the consent of the Lessor must be obtained.
I. PETS
36. Animals or pets may be kept by Lessees. However, such permission is revocable at any time by the Lessor. Animals or pets are not permitted on elevators or in any of the public areas of the building unless carried or controlled on a leash.
37. Lessor shall have the right to limit the number of pets living in an apartment if the number of pets creates an unhealthy environment for other Lessees.
38. All residents and their agents are responsible for curbing their animals and keeping them from urinating and/or defecating on or near the building, planters and flower beds.
