  • Accepting an offer in NYC

Question. If you're about to accept an offer as the seller, do you have to stick with the buyer even if someone better shows up? Are offers binding for the buyer if it's written? And is it binding for the seller if the seller accepts in writing an offer?

I'm sure there are lots of situations where an offer has been accepted, but a new buyer or even the neighbor comes over the top with a higher and better offer. What are a seller's options in that case?

I don't believe you are legally obligated as the seller to stick with your first accepted offer unless there is a fully executed contract in place. If a higher offer comes in, perhaps you can give the original accepted offer the courtesy of asking if they can match the newer, higher offer?
